Contestation Judgments and Grievance Procedures against Decisions and Orders

Why Attend

Grievance is an alternative way to resolve some administrative disputes, by ending them in their early stages and achieving administrative justice in a more accessible manner. The legislator has determined that if individuals had approached the administration before resorting to the administrative judiciary, many problems could have been resolved amicably, in a short time, and without incurring the costs required by the judicial process. This is because the issuance of a flawed administrative decision does not necessarily mean that the administration intended the decision to be so. In addition to the above, filing a grievance with the administration leads to results that cannot be achieved through the judicial process. Judicial oversight primarily concerns aspects of legitimacy, while the administration can amend or annul a decision simply on the grounds of its inappropriateness.
