Legal Aspects of Electronic Management

Why Attend

Both administrative decisions and contracts are among the most important topics addressed by administrative law. The administrative decision is the mouthpiece of the administration and the true translation of its will, both explicitly and implicitly. It is the core of the administrative process, which has steadily evolved with the development and expansion of administrative activity. Unlike other electronic contracts, the electronic administrative contract is distinguished by its unique nature. It must incorporate both the characteristics of an electronic contract and the characteristics of an administrative contract. It constitutes an indispensable necessity for the administration in its transition from paper-based to electronic administration. As is the case with paper contracts, the electronic contract used within private law preceded the emergence of the electronic administrative contract. Administrative activities are more important and sensitive than private activities, due to their connection to public finances, the public treasury, and public policies. This makes their development and the introduction of new concepts subject to in-depth studies before risking the transition from one system to another.

Methodology

This course is structured by dividing the tasks as described above, and providing training and presentations for each group of tasks. This enables participants to understand and practice legal management tasks and acquire the necessary skills through a methodology that establishes the foundations for each type of task.

Objectives

Characteristics and concepts of laws and regulations

Types and divisions of laws, and the persons subject to each law

All employees working in legal, administrative, and financial affairs, internal control units, and all members of administrative investigation committees in the public and private sectors, including directors and their deputies, and employees in legal departments, administrative affairs departments, and the civil service.

Target Competencies

Removing ambiguity and understanding the concept of both electronic administrative decisions and contracts.

Determining the extent to which electronic administration is successful in meeting its legal requirements, as they are a legal means of expressing its will in managing public services.

Understanding the impact of electronic administration on the pillars of administrative decisions.

Achieving a sound legal system that is consistent with the specificity of electronic administrative decisions and contracts.
